Terms of Use

Please read these Terms of Use ("Terms") carefully before using ThumbnailMaker ("the App") developed by William Jiamin ("Developer," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions and these Terms. This license does not allow you to:

• Distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time, except as permitted by Apple's Family Sharing.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Copy, modify, or create derivative works of the App or any part thereof.
• Remove, alter, or obscure any proprietary notices in the App.

2. Your Content

You retain full ownership of any images, text, designs, or other content you create or import using the App ("Your Content"). We claim no rights over Your Content. You are solely responsible for ensuring you have the necessary rights to any media you import into the App.

3. In-App Purchases

The App offers a one-time lifetime premium purchase that unlocks additional features. All purchases are processed by Apple through the App Store.

• Payment. The price is displayed in the App before purchase and is charged to your Apple ID account upon confirmation.
• No subscription. The premium upgrade is a one-time purchase, not a recurring subscription.
• Refunds. All refund requests must be directed to Apple in accordance with their refund policy. We do not process refunds directly.
• Restoring purchases. You may restore your purchase on any device signed into the same Apple ID at no additional cost.

4. Acceptable Use

You agree not to use the App to:

• Create content that infringes on the intellectual property rights of others.
• Produce, distribute, or promote illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable material.
• Violate any applicable local, state, national, or international law or regulation.
• Interfere with or disrupt the integrity or performance of the App.

5. Intellectual Property

The App, including its design, code, graphics, templates, stickers, and other assets, is owned by the Developer and protected by copyright and intellectual property laws. These Terms do not grant you any rights to the Developer's trademarks, branding, or other intellectual property, except the limited license in Section 1.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR ITS IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination, the license granted in Section 1 will immediately cease.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle (and do not collect) your information.

11. Children

The App does not collect personal information from any user, including children under 13. There are no accounts, no data collection, and no online features that would pose a risk to minors.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to conflict-of-law principles.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised effective date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
